Welcome. These Terms of Service ("Terms") govern your use of the blustarsoftware.com website, the Blu Star customer portal, and the messaging and notification services we provide ("Services"). Please read them carefully. By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who we are, and who these Terms apply to

Collabetive Services, LLC ("Collabetive", "we", "us") provides pest control and field service management software, including The Blu Star Field Service Management System, to service companies in the United States. These Terms apply to:

  • Visitors to blustarsoftware.com.

  • Customers of our client companies who use a customer portal we host, or who receive email, text message, or phone notifications sent through our platform on a client company's behalf.

  • Client companies that license our software, and their authorized users, to the extent these Terms cover subject matter their license agreement does not.

If your company has signed a License Agreement with Collabetive for the use of our software, that agreement — together with its Terms and Conditions, Acceptable Use Policy, Sales Order, and any Statement of Work — governs the software, and it controls over these Terms wherever the two address the same subject. These Terms are not intended to modify, limit, or add to that agreement. They cover this website, the customer portal, and our notification services, which that agreement does not address in full.

2. Use of the website

You may use this website for lawful purposes only. You agree not to:

  • use the site in any way that breaks an applicable law or regulation;

  • attempt to gain unauthorized access to any part of the site, any account, or any system or network connected to it;

  • interfere with or disrupt the site, including by introducing malicious code, scraping at a volume that degrades service, or circumventing any security or rate-limiting measure;

  • use the site to transmit unsolicited commercial messages; or

  • reproduce, resell, or commercially exploit any part of the site without our written permission.

We may suspend or terminate access to the site or the Services at any time if we believe these Terms have been breached.

3. Accounts and the customer portal

Some parts of the Services require an account. If you have one:

  • You are responsible for the accuracy of the information on your account, including your phone number and email address.

  • You are responsible for keeping your credentials confidential, for using a strong password that you do not reuse on another account, and for activity that occurs under your account.

  • Tell us promptly if you believe your account has been accessed without your authorization.

Accounts for customers of a client company are created and administered by that company. Requests to correct or close such an account should go to that company first; we will assist where we can.

Authorized users at a licensed client company are additionally subject to that company's License Agreement and to our Acceptable Use Policy.

4. Text message (SMS) notifications

Our Comm Center platform sends text message notifications on behalf of client companies to their customers, about scheduled service. Participation is voluntary and requires your prior express consent.

  • Consent. You will only receive text messages after you opt in. Consent is not a condition of purchasing any service. Details of how consent is collected are in our SMS Opt-In Policy.

  • Message content and frequency. Messages are transactional — notices of upcoming service and reminders on the day of service. Frequency follows your service schedule, generally one to two messages per scheduled visit. We do not send marketing text messages through this program.

  • Rates. Message and data rates may apply. Your mobile carrier's standard charges apply to messages you send and receive. Neither Collabetive nor your service provider charges you for these messages.

  • Help. Reply HELP to any message for contact information, or reach us at support@thecollabetive.com or 763.231.8900.

  • Opting out. Reply STOP to any message to stop receiving them. We also honor CANCEL, END, QUIT, UNSUBSCRIBE, REMOVE, OPTOUT, OPT-OUT and TD. Reply UNSTOP to resume. Opting out does not affect your service.

  • Delivery. Message delivery depends on your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. You agree to notify your service provider if you give up or change a mobile number that is enrolled.

The SMS Opt-In Policy forms part of these Terms.

5. Email and phone notifications

We also deliver service notifications by email and automated phone call on behalf of client companies. You may unsubscribe from non-essential email at any time using the link in the message or through your customer portal preferences. Transactional messages about a scheduled service or a billing matter may continue while your account is active.

6. AI-assisted features

Parts of the Services use artificial intelligence to summarize and surface information already held in an account — for example, producing a short written summary of a customer record, or a briefing for a technician ahead of a service visit. To generate these, relevant account and service information is processed by third-party AI service providers on our behalf. Our Privacy Policy describes how that information is handled.

  • Assistive only. AI-generated output is a convenience, not a system of record. It may be incomplete or inaccurate. It should not be relied on as the sole basis for a service, treatment, billing, or regulatory decision — verify it against the underlying records before acting on it.

  • Notifications are not AI-generated. The text message, email, and phone notifications described in sections 4 and 5 are produced from templates, not by artificial intelligence.

  • Acceptable use. You agree not to use AI features to generate unlawful, harassing, or deceptive content, to attempt to access data belonging to another party, or to probe or circumvent the limits of the underlying models.

  • Availability. AI features may be changed, limited, or withdrawn at any time.

7. Content and intellectual property

The website and the Services, including their text, graphics, logos, software, and layout, are owned by Collabetive or its licensors and are protected by United States and international intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use them for their intended purpose. No other rights are granted.

Data that a client company enters into the software remains that company's data. Collabetive asserts no ownership rights in it. We process it under the terms of that company's License Agreement and our Privacy Policy.

8. Third-party services and links

The Services rely on third-party providers — including messaging carriers, cloud infrastructure providers, and AI service providers — to deliver messages, host data, and generate the features described in section 6. The website may also link to third-party sites we do not control. We are not responsible for the content, policies, or practices of any third-party site, and a link is not an endorsement.

9. Privacy

Our Privacy Policy explains what information we collect and how we use it, and forms part of these Terms. We do not sell your mobile phone number. No mobile information is shared with third parties or affiliates for marketing or promotional purposes, and text messaging opt-in data and consent are not shared with any third parties.

10. Disclaimer of warranties

Except where a signed License Agreement with Collabetive expressly provides otherwise, and to the fullest extent permitted by law, the website and the Services are provided "as is" and "as available", and Collabetive disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any particular message will be delivered.

Nothing in this section limits or replaces any express warranty given to a licensed client company under its License Agreement.

11. Limitation of liability

To the fullest extent permitted by law, and except in cases of gross negligence or willful misconduct, Collabetive will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or relating to your use of the website or the Services — whether based in contract, tort, or any other theory, and whether or not we were advised of the possibility of such damages.

For a licensed client company, Collabetive's aggregate liability is limited as set out in that company's License Agreement. For everyone else, and where liability cannot otherwise be excluded, Collabetive's total aggregate liability arising out of or relating to the website or the Services is limited to one hundred dollars ($100).

Nothing in these Terms limits liability that cannot lawfully be limited.

12. Indemnification

You agree to indemnify and hold harmless Collabetive, its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the website or the Services, your breach of these Terms, or your violation of any law or the rights of a third party. This is in addition to, and does not replace, any indemnification obligation under a signed License Agreement.

13. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms, the website, or the Services that cannot be resolved informally will be resolved by litigation in the State or Federal Courts located in Minneapolis, Minnesota, and you consent to the exclusive personal jurisdiction of those courts and waive any claim that they are an inconvenient forum.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the website or the Services after a change takes effect means you accept the revised Terms. Changes to a licensed client company's License Agreement are made under that agreement's own modification process, not by a change to this page.

15. Severability and waiver

If any provision of these Terms is found unenforceable, it will be modified only so far as needed to make it enforceable, and the remaining provisions stay in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.
